American Broker: Zack from Vivint
The scammers sent a fraudulent cold call to my PBX line to “qualify” me for a “free home security system” as long as I provide my name and phone number before my call gets transferred to their American broker, Vivint, a BBB-accredited security system provider that operates out of 4931 N 300 W, Provo, UT 84604-5816.
User complaints on their BBB and TrustPilot listings indicate patterns of fraudulent activity, such as:
- Charging $600 in termination fees after two weeks of use.
- Referring individuals who ask to never be contacted again to a toll-free number parked for a pick-a-scam service.
- Hiring college interns to serve as door-to-door salesmen who run credit checks without the clients’ consent.
- Opening up a $4,000 line of credit in their customers’ names without prior consent.
- Having their salesmen repeatedly come to a client’s home even after being asked to stop by falsely claiming many of their neighbors purchased their equipment.
- Refusing to cancel services by claiming the customer wasn’t listed on the account to cancel.
- Having their salespeople falsely claim that they will buy the customer out of their existing security contract.
- Refusing to allow customers to take videos of the installation process.
- Disconnecting their customers’ outside Internet cable and refusing to fix it.
The company’s BBB listing also features several government actions, including:
- A settlement with the Division of Occupational and Professional Licensing that includes 5 years probation.
- A consent judgement with the Arizona Attorney General over allegations of false representations to induce customers to sign a contract. The company was ordered to pay $75,000 in restitution to Arizona consumers, $285,000 in civil penalties and $40,000 in attorney’s fees, as well as to refrain from making false representations and to provide the consumer an electronic contract when soliciting over the phone.
On November 6, 2023, the company was sued in the Western District of Washington for violations of the state’s Commercial Electronic Mail Act (CEMA) and Consumer Protection Act (CPA) after the plaintiff, Nathan Brinton, received 29 spam emails from the company. The case was remanded to the Clark County, Washington Superior Court on August 7, 2023.
The company has also settled a $6 million TCPA class-action lawsuit on February 24, 2015 and a $6.5 million TCPA class-action in the Superior Court of California on September 7, 2023.
