Earlier today while I was browsing my TikTok For You Page, I was shown a promoted video from the user “CrazyKamalaShop” advertising their prank mailer written under the guise of Kamala Harris’ presidential campaign to falsely claim the recipient was being charged a $250/month subscription for her “diamond membership.” In order to “cancel,” the recipient will be asked to scan a QR code to a fake Harris campaign site where the “donate now” button redirects to a WinRed campaign for Trump National Committee JFC, Inc.
I was able to trace the trademark rights of “Sleepy Joe’s Garage” to JS Stewart Holdings, LLC and Jake Stewart from Scottsdale, Maricopa County, Arizona. Stewart’s company has also been known to send fraudulent mailers on behalf of the Biden campaign before Pres. Biden dropped out.
I am in firm belief that these letters violate several federal and/or state laws, such as:
- 18 U.S.C. § 912 (False Personation of an officer or employee of the United States) - The prank letters were written under the false personation of President Biden and, later, Vice President Harris without any clear indication that it was a prank, and that the letters also come with a fake receipt for a $250/month membership. Each violation can result in up to a three-year prison sentence.
- 18 U.S.C. § 1341 (Mail fraud) - Using the mail for the purpose of executing, or attempting to execute, a scheme to defraud. As the letters are official-looking documents that threaten a $250 fee if the recipient doesn’t scan the QR code in time, these letters could constitute a federal felony that can result in up to 20 years in prison and a fine of $250,000.
- Voter Suppression - Intentionally deceiving qualified voters to prevent them from voting. It is considered a crime at the federal level and was recently applied against Steve Kramer for his illegal Biden robocalls.
