This is a T-Mobile number. My recommendation would be to send them a legal demand to hold their scamming clients accountable. Their emails are: Abuse [email protected]; T-Mobile Privacy Office Support [email protected]; [email protected]; Freier, Jon [email protected]; Sievert, Mike [email protected]; T-Mobile Compliance <[email protected]

I would be inclined to use something along these lines:

Subject: Legal Complaint – Fraudulent and Illegal Activity by T-Mobile Subscriber (863) 338-4752

Dear T-Mobile Team

I am writing to formally file a legal complaint against the T-Mobile subscriber using the phone number (863) 338-4752. This number is engaged in fraudulent and illegal activity, specifically impersonating Apple and Apple Pay in order to deceive and potentially defraud me.

The individual behind this number has been sending text messages falsely representing themselves as Apple and Apple Pay, which is a clear violation of multiple federal and state laws. As this number is associated with your network, I hold T-Mobile accountable for the actions of its customers and urge you to take immediate action.

Legal Violations:

  1. Fraud and Identity Theft (18 U.S. Code § 1028) - By impersonating Apple and Apple Pay, this number is committing fraud and identity theft by misleading recipients into believing they are communicating with legitimate institutions. Such fraudulent misrepresentation is illegal under federal law.
  2. Wire Fraud (18 U.S. Code § 1343) - If this number is using digital communications (including text messages) to further fraudulent schemes, they may be in violation of the federal wire fraud statute.
  3. Deceptive Practices (Section 5 of the Federal Trade Commission Act, 15 U.S. Code § 45) - The fraudulent impersonation of Apple is a deceptive practice that misleads consumers, which violates the FTC’s prohibition against unfair and deceptive acts or practices.
  4. Telephone Consumer Protection Act (TCPA) (47 U.S. Code § 227) - If the text messages sent from this number are unsolicited and are part of a scheme to defraud or deceive, it constitutes a violation of the TCPA, which protects consumers from fraudulent or deceptive communication practices.
  5. State Consumer Protection Laws - Depending on the jurisdiction, the fraudulent activity may also violate state-specific consumer protection laws, including those governing unfair trade practices and deceptive marketing.

As a mobile service provider, T-Mobile has a legal responsibility to ensure that customers using its network do not engage in illegal activities, including the transmission of fraudulent communications. I am requesting that T-Mobile immediately investigate the actions of this subscriber and take appropriate action, including but not limited to suspending or terminating their service.

Please provide a written response confirming that you have received this complaint and outlining the steps T-Mobile will take to address this matter. If this issue is not resolved in a timely manner, I will be forced to pursue further legal action.

Sincerely,

[Your Name]

Will do…thanks for the contact info. Been getting many T-mobile numbers as of late.

You are welcome! Yes, same here, my friend. And T-Mobile fought me on my complaints lying how all these calls and texts were from “non-existent or unassigned numbers”. How could they be “unassigned” when I called every single one of them and had all sorts of “Kumar Brahmaputra” and “Sanjeev Chupacabra” answer?

We need to keep pressuring the carriers to be more compliant and they must have fear of legal consequences for turning a blind eye to illicit behaviors. Contrary to what some softspoken mild-mannered “kitten people” here state, the mild and over-the-top-polite approach never works with lazy and greedy people who don’t care about anything and anyone. We have to be hungry wolves!

P.S: On a side note, the aforesaid “kitten people” likely don’t even live in the US and reside in some cute Christmas fairy-tale LalaLand of Norway or something like this. They have no idea what we, regular American people, deal with DAILY! We have “Habibs”, “Sanjeevs” and all other sorts of “Ravis” on our case 24/7, stealing and harassing us!

He did not think that stealing and lying was abusing people. Just naughty words.

I asked them whether or not I could talk to people who were not the color of poop. His comeback was quite weak: “F you, why are you calling here?”
