Agent Boost Marketing, TCPA violators DBA "Medicare Advocates" (SETTLEMENT REACHED!)

@MehNamesJeff, I have investigated this Acquity, LLC and found several anomolies, including:

  • Their listed Las Vegas, Nevada address is likely false, as their website lists their true identity as Acquity BPO (Belize) Limited from 304 Newton Barracks Road, Belize City, Belize and 11123 Hummingbird Hwy, Belmopan, Belize.
  • Their toll-free number not only being out of service, but also being listed on Google Maps as being tied to an “Acquity” location at 1745 Shea Center Dr,. Highlands Ranch, Colorado, 80129.
  • The aforementioned Google listing being tied to a LinkedIn page for their Colorado location that also shows most of their employees operating out of Belize and Guyana, with only 3 Americans and 3 bhenchods.

Also, Agent Boost’s response is quite silly, to say the least. They ARE the principal and are therefore potentially liable for the actions of their lead generators. It’s amusing that it appears that they might be just trying to push the liability on Acquity lead generators. Vicarious liability clearly states that the principal might be (and often is) held accountable for the actions of their agents.

My opinion regarding the agent of Boost Marketing Acuity is to file a complaint against them and their principal with the State of Nevada. I tend to get better traction with various State agencies vs. the Federal ones when I share concerns with them. Here it is:

I think it will make sense to copy [email protected] on your email to Boost Marketing when you complain to them about the illegal nature of robocalls without Prior Written Consent and how they might be liable for the actions of their agent - Acuity - due to being a principal.

@OfclyGoodenough Through your shared intelligence, I’d certainly like to raise what you’ve found and bring the fight straight to their doorstep, about how their claimed address may be fake, their number is dead (etc etc), if you are fine with that. Perhaps, as I’ve done before, you’d like to be CC’d in as well should you also like to provide a direct say at any point?

I think your best bet might be to shed light on possible unethical conduct and alleged illegal telemarketing to Brendan Carr at FCC. Since Boost Marketing appears to operate out of Nevada, you can file the complaint with the State of Nevada and share your concerns with them. I previously shared the link with you. Acuity appears to operate out of the State of Colorado, you can file complaints with them, too:

In the meanwhile, I want to get an ‘email exchange’ rolling with Acquity / Acquity’s Legal Counsel and see where it goes first - then share everything in one go with Brendan (etc).

Still waiting on Acquity / Acquity’s Legal Counsel to reach out to me, as previously discussed with Reannan. If I don’t wait, then that’ll be problems for me, they can argue that I didn’t give them sufficient time to respond etc. If they don’t reach out, within a reasonable timeframe, I will reach out to them myself - If I hear nothing back, regardless, if I’m unsatisfied with their proposals, then it’ll be SERIOUS problems for them… No doubt lol.

  3. Lack of Transparent Consent:
    Based on information available from public forums and regulatory guidance, it is unclear whether these entities are securing the kind of clear, informed, and documented consent required under FCC rules as updated in December 2023.

Please note that I do not have direct evidence of wrongdoing, and these concerns are based on publicly available information and my reasonable suspicion. My intent is simply to bring these concerns to your attention so the Commission may evaluate whether these entities are acting in compliance with federal laws.
