As a victim of such illegal robocalls, @MehNamesJeff is also entitled to demanding to know the names of the companies placing these nuisance calls on behalf of Medicarians and Sierra Insurance. I think it is fair for him to demand this information.

Perhaps, reword “America” as the “US”. Also, it will be a good idea to rephrase “particularly those working out of India” to be “particularly foreign-based call center operations”. We do not want to “single out” India. We all know numerous scammers are located there, but I have experienced a fair share of harassment from the Filipinos or Pakistanis too.

Hi - I think it’s important to anticipate that they will deflect by saying “we didn’t call you” as it was a contractor who made the call from India. That contractor has many customers that sign up for their service and they rotate where the call ends up, sometimes depending upon state where the broker is licensed. So I’d say “calls that Sierra contracted with an outside agency for which Sierra is responsible and culpable.” For resolution, I’d ask for a list of contractors used for these robo calls so the real culprits can be addressed. Just my 2 pesos.

Good point. From a legal standpoint, the fact that Sierra contracted foreign-based illegal robocalling call center still makes them liable for TCPA and TSR violations. Many US companies do it and often end up settling with victims of such illegal robocalls.
I spoke with a few TCPA attorneys before about this topic. They all told me that one “should always go after US-based entities who sourced such illegal robocallers”.
Ah shame, I’ve already sent it and currently still waiting for a reply - however good point. I’ll do my best to “sneak” in back in.

Yes, this seems fairly accurate on your end and should be reflective of things you have experienced.
It is pointless to state the obvious to him now. He is playing games with you and is just using legal “cookie-cutter language”. Your best bet is to complain to authorities in California and Florida about Sierra’s illegal robocalls and copy and paste your entire communication with their officers and attorneys.
