- Impersonation of Medicare: Entities operating under the name “Health Solutions” are engaging in fraudulent activities by impersonating Medicare. This practice not only misleads and deceives individuals but also violates federal regulations including, but not limited to, the Federal Trade Commission (FTC) Act, which prohibits deceptive practices, and Medicare fraud statutes under 42 U.S.C. § 1320a-7b.
- Robocalling: The same entities are involved in illegal robocalling practices. This is a clear breach of the Telephone Consumer Protection Act (TCPA), codified at 47 U.S.C. § 227, which restricts the use of automated dialing systems and prerecorded voice messages without consent.
- Credit Card Scams: Entities operating under names such as “Credit Card Services” are conducting fraudulent schemes to scam individuals under the guise of offering credit card services. These actions are in violation of the Credit Card Accountability Responsibility and Disclosure Act (CARD Act), and may also breach regulations enforced by the FTC.
- Identity Theft Operations: There are also reports of operations under names like “Underwriting Loan Department” which are suspected to be involved in identity theft. This is a violation of the Identity Theft and Assumption Deterrence Act (ITADA), 18 U.S.C. § 1028, and other related statutes aimed at protecting personal information.
Given these serious concerns, I formally demand that FracTel take immediate action to investigate and address these violations. Specifically, I request the following:
- Discontinuation of Services: Terminate the telephone numbers associated with the aforementioned fraudulent activities.
- Internal Review: Conduct a thorough review of your policies and procedures to prevent such misuse of your services in the future.
- Notification: Inform us of the actions taken to resolve these issues within 14 days from the date of this letter.
