“Sheryl” revealed that “Noxitril” was distributed by Innovative Distributors, LLC, which is listed on Dunn & Bradstreet as operating from a Malibu household under the leadership of Shirin Pourmand, who is also listed as the Managing member of Bodee, LLC.
On December 13, 2007, Bodee started distributing a fraudulent male enhancement supplement by the name of “Zencore Plus,” a successor to their original “Zencore” dietary supplements that were voluntarily recalled on August 31, 2007 for containing potentially harmful, undeclared ingredients. On July 27, 2009, the United States Food and Drug Administration issued a warning to Bodee, LLC for
- Selling Zencore Plus without an approved FDA application (Sections 301(d) and 505(a) of the Act, 21 U.S.C. §§ 331(d) and 355(a))
- Failure to reveal that their product contains benzamidenafil or can cause harmful side effects (Section 502(a) of the Act, 21 U.S.C. § 352(a)).
- Failing to label adequate directions for intended uses (Section 502(f)(1) of the Act, 21 U.S.C. § 352(f)(1))
- Failure to add adequate warnings for user protection (Section 502(f)(2) of the Act, 21 U.S.C. § 352(f)(2))
- Demonstrating a continuing pattern and practice of marketing violative products.
