This one’s pestering me with cold calls today for Viagra, etc. from “United Parmacy” and that they come from India, Singapore, but says they’re located in Texas

the carrier is IP Horizon, which is the same as “Call 48” and “HFA Holdings”. They have quite the history:

@Jhawk I think it would make sense to write them a stern email to demand accountability for their clients’ illegal conduct. Their emails are:

I’d be inclined to use something along these lines:
Subject: Demand to Hold Your Client Accountable for Robocalling, Spamming, and Potentially Illegal Activity
IP Horizon Team,
I am writing to formally demand that IP Horizon immediately investigate and take action against your client, who is engaging in unlawful robocalling and potentially illegal pharmaceutical sales practices. Today, I received multiple unsolicited robocalls promoting prescription medications such as Viagra from a supposed “United Pharmacy.” The calls originate from the phone number (334) 739-1596 and claim to be from a business based in Texas. However, further inquiry suggests the calls are actually originating from India or Singapore, indicating fraudulent misrepresentation.
It appears that your client is:
- Spamming and scamming consumers through robocalls, in clear violation of the Telephone Consumer Protection Act (TCPA) and other applicable federal and state laws.
- Promoting and selling prescription medication without requiring a valid prescription, which may violate the Controlled Substances Act and the Food, Drug, and Cosmetic Act.
- Falsely misrepresenting their location to create the illusion of a domestic U.S. business, which is deceptive and misleading.
- Contacting me without my Prior Written Consent (PWC), which is a direct violation of the TCPA’s restrictions on telemarketing calls.
Furthermore, it appears evident that IP Horizon is operating under the same ownership as HFA Services LLC, d/b/a Call48, a voice service provider recently issued a cease-and-desist letter by the Federal Trade Commission (FTC). The FTC’s letter specifically warned Call48 of the legal consequences of transmitting illegal robocalls. Given the shared ownership, IP Horizon may be complicit in similar unlawful activities, raising serious concerns about your company’s business practices. I encourage you to review the FTC’s action (Cease-and-Desist Letter) as it may be relevant to your obligations.
I demand that IP Horizon:
- Immediately terminate service to this client and cease transmitting illegal robocalls.
- Provide me with the identity and contact information of the client responsible for these calls.
- Confirm in writing that IP Horizon is taking appropriate measures to prevent further illegal activity by this or any other client.
Please confirm receipt of this demand and provide a written response within 10 business days.
